Terms & Conditions

Terms and Conditions

Welcome to CarNyumba (carnyumba.com), Kenya's trusted platform for car prices, vehicle comparisons, and auto listings. By accessing or using our website, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our platform to research car prices or list vehicles for sale. If you do not agree with any part of these terms, you should discontinue using our website immediately.

1. Overview of Our Services

CarNyumba provides an online automotive information portal and marketplace designed for car buyers, sellers, and enthusiasts across Kenya. Our service allows users to browse estimated market prices for both foreign-used imports (ex-Japan, ex-UK, ex-Australia) and locally used cars registered with NTSA. We also enable motor dealers, showrooms in Nairobi, Mombasa, Nakuru, Eldoret, and Kisumu, as well as individual sellers to list vehicles for sale.

CarNyumba is not a car dealership, motor vehicle broker, or financing institution. We do not own, inspect, buy, or sell any of the vehicles advertised on the website. We act solely as an information hub and advertising medium connecting potential buyers with sellers.

2. User Obligations and Account Registration

To access certain features of CarNyumba, such as posting a car advert or saving favorite listings, you may be required to register an account. By creating an account, you agree to:

  • Provide accurate, current, and complete personal details, including a valid Kenyan phone number and email address.
  • Maintain the security and confidentiality of your account login credentials.
  • Take full responsibility for all activities, messages, and listings published under your account.
  • Notify us immediately at [email protected] if you suspect any unauthorized access to your account.

Users must be at least 18 years of age to post listings or enter into interactions through CarNyumba. We reserve the right to suspend or terminate accounts that breach these terms or engage in fraudulent activities.

3. Car Listings and Content Guidelines

Sellers posting vehicles on CarNyumba must ensure that all information provided in their adverts is accurate, truthful, and up to date. When submitting a listing, you must adhere to the following rules:

  • Vehicle Ownership: You must be the legal owner of the vehicle or have explicit written authority from the owner to sell it.
  • Accurate Details: Vehicle details such as the make, model, year of manufacture, mileage, fuel type, transmission, and pricing must be accurate. If the vehicle is an ex-Japan import, it must comply with the Kenyan 8-year age limit rule enforced by KEBS and KRA.
  • Clear Pricing: All prices listed on CarNyumba must be stated in Kenya Shillings (KES). Sellers must clearly indicate whether the price is inclusive of KRA import duty, NTSA logbook transfer fees, and clearance costs at the Port of Mombasa, or if it is a net price.
  • Honest Condition Reports: Sellers must disclose the true condition of the car, including whether it is locally used, has been involved in major accidents, or requires mechanical repairs for Kenyan roads such as rough murram roads upcountry.
  • Prohibited Content: Advertisements containing misleading pricing, stolen vehicles, fake contact details, offensive language, or unauthorized photos taken from other websites are strictly prohibited.

CarNyumba reserves the right to edit, decline, or remove any car listing that violates these terms or fails our content moderation checks without prior notice.

4. Pricing Information and Marketplace Disclaimer

The car price guides, estimated valuation tools, and duties calculators published on CarNyumba are provided for general informational purposes only. While we make every effort to update market values reflecting current trends along Nairobi's Ngong Road car yards, Mombasa car showrooms, and online auction sites, actual vehicle prices depend on negotiating factors, vehicle condition, and exchange rates.

CarNyumba does not guarantee that a car listed on the website will sell at the advertised price or that a buyer will secure financing from local banks or SACCOs based on our price estimates. Buyers are strongly advised to conduct independent due diligence before making payments.

5. Buyer Responsibilities and Due Diligence

Purchasing a motor vehicle in Kenya involves significant financial investment and legal obligations. CarNyumba strongly advises all prospective buyers to take the following precautionary steps before handing over any money to a seller:

  • Physical Inspection: Always inspect the vehicle in person in a safe, open location during daylight hours. Test drive the car on both paved roads like Thika Road or Mombasa Road and rough surfaces to check suspension and mechanical health.
  • Official Search: Perform an official NTSA TIMS logbook search to verify the genuine owner of the car and ensure there are no financial caveats, bank charges, or police holds on the vehicle.
  • Mechanical Check: Hire an independent mechanic to carry out a comprehensive technical inspection of the engine, chassis, transmission, and bodywork.
  • Verify Import Documents: For foreign-used imports, check the KEBS Certificate of Roadworthiness (QISJ inspection) and KRA customs clearance documents to confirm legitimate entry into Kenya.
  • Safe Transactions: Never send deposit money, commitment fees, or full payments via mobile money or bank transfer before viewing the vehicle and verifying the seller's identity and logbook.

CarNyumba is not liable for any financial losses, fraud, misrepresentation, or legal disputes arising from agreements made between buyers and sellers encountered on our platform.

6. Fees and Paid Services

Browsing car listings, reading price guides, and contacting sellers on CarNyumba is free for general users. However, we offer premium paid services for sellers, such as featured listing slots, dealer banner advertisements, and priority placement on our search pages.

All fees for paid services are clearly stated before payment and must be paid in Kenya Shillings through approved local payment channels. Fees paid for advertising space or featured placements are non-refundable once the service has been activated, even if the vehicle is sold before the listing duration expires.

7. Intellectual Property Rights

All content published on carnyumba.com—including text, graphics, website design, brand logos, code, database structure, and price comparison algorithms—is the exclusive property of CarNyumba and is protected by the Copyright laws of Kenya and international intellectual property treaties. Users may not copy, reproduce, distribute, or scrape content from this website for commercial purposes without our express written consent.

8. Limitation of Liability

CarNyumba provides the platform on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, availability, or accuracy of the listings, price data, or user interactions on the site.

To the maximum extent permitted by Kenyan law, CarNyumba, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of the site, inability to use the site, or reliance on any car listings, prices, or dealer claims made on our platform.

9. Indemnification

You agree to indemnify, defend, and hold harmless CarNyumba, its officers, affiliates, and employees from any claims, liabilities, losses, damages, costs, or legal fees arising from your breach of these Terms and Conditions, your misuse of the platform, or your violation of any third-party rights, including vehicle ownership disputes and fraudulent sales.

10. Governing Law and Dispute Resolution

These Terms and Conditions shall be governed by, interpreted, and enforced in accordance with the Laws of the Republic of Kenya. Any disputes or claims arising out of or in connection with the use of carnyumba.com that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of Kenya sitting in Nairobi.

11. Changes to Terms and Conditions

CarNyumba reserves the right to modify or update these Terms and Conditions at any time to reflect changes in Kenyan automotive regulations, tax laws, or platform policy. Updated terms will take effect immediately upon being posted on this page. Your continued use of the website following any changes constitutes acceptance of the new terms.
